Terms of agreement
- The Supplier will supply, prepare and set up the decorations at the function described below and supply all equipment and staff necessary to enable him to do this.
- The quality of the decoration will be of the standard that one would expect of a quality provider of this sort and as viewed by the customer in albums or on the www.elegantwedding.co.uk website as demonstrated by the Supplier
- The Supplier assumes all risk connected with the decoration at the function and will carry public liability insurance in an amount acceptable.
- The Customer will pay the deposit plus VAT on the signing of this agreement and the balance of the Supplier's fees plus VAT on the …………….day of…………………………200….
5 The Customer may cancel this contract at any time up to 3 months before the function and will forfeit the deposit. If the Customer cancels the function in the last 3 months before the function the Customer will pay the whole of the Supplier's fee less any amounts which the Supplier acting reasonably would have but did not spend on materials, hire of equipment or labour.

The products and services offered by third party companies are not a part of our Company and under no circumstances shall we be liable for any losses or damages caused by a third party company. Such limitation shall also apply with respect to damages incurred by reason of other services or goods received through by a recommended third party company. If you accept any products or services offered by a third party company, then all communication must be between you and the third party company. We will not be responsible or liable for any communication or misrepresentation of the third party company. You acknowledge and agree that we are not responsible for the availability of such external sites, and do not endorse and are not responsible or liable for any content, advertising, products or other materials on or available from such sites.
You agree and acknowledge that you are solely responsible for evaluating any goods or services offered by us or third parties via the Site and that we will not be a party to or in any way responsible for any transactions between you and third parties.

TERMS AND CONDITIONS - WEDDINGS & CORPORATE SECTIONS Products/Services
Elegant Weddings reserves the right to change all or some of the contents or packaging to provide an item of equal or greater value without notice. All products/services are subject to availability. Goods (products/services) hired remain the property of Elegant Wedding Services. Equipment hired (including glass-ware, stands, pedestals, props and artefacts) remains the property of Elegant Wedding Services at all times.
Hire Charges
The Stated Hire Charges on the Order-Form/Invoice are for the duration of the contract. Deposits (for order confirmation) are non-refundable. If Items are returned late or after the agreed hire period, a penalty charge is payable by the Customer at the same rate of hire per item on the Order-Form/Invoice, each day until the item is returned. Where the hired items/equipment are not returned in the same condition as when collected due to “loss” or “damage”, the Customer will be liable to pay a penalty charge at a rate of ten (10) times the rate of hire per item. Hire Charges accrue until the full settlement is made.
Customer's Responsibility
The Customer acknowledges that upon receipt of the goods/equipment that they accept full responsibility for these items, and in the case of “hire”, until they are returned to, or collected by, a member of staff of Elegant Weddings.
For Elegant Wedding Services Responsibility
For Elegant Weddings will maintain the agreed hire rates and goods for the duration of the contract. Where appropriate, equipment will be inspected and tested in accordance with relevant statutory requirements. Wherever possible Elegant Wedding Services will provide the goods/equipment and services as agreed, however the Customer acknowledges and accepts that in unforeseen circumstances, substitutions will be made as necessary within sufficient time.
Payment
All deposits and payments are non-refundable. The Customer will pay all outstanding balances as per the date agreed in the contract and will be liable for all legal charges incurred by For Elegant wedding Services Ltd in the recovery of amounts overdue, Equipment and/or Goods. Any cheques that are unpaid or represented by the bank will incur an administration fee of £35+vat, which the Customer agrees to pay. All sums due from either of the parties to the other which are not paid on the due date shall bear interest from day to day at the annual rate of 4% over the base lending rate of Barclays Bank plc
Cancellation
The Customer must inform Elegant Wedding Service, in writing, the cancellation of goods/services/or hire items that have been ordered at least 3 months in advance from function date. The customer remains liable to pay in full for all goods/services/items that have been ordered, where notice of cancellation is less than 8 weeks from the function date.
Force Majeure
Elegant Wedding Services shall be released from their respective obligations in the event of national emergency war prohibitive governmental regulation or if any other cause beyond the reasonable control of themselves
Change of address
Each of the parties shall give notice to the other of the change or acquisition of any address or telephone telex or similar number at the earliest possible opportunity but in any event within 48 hours of such change or acquisition.
The Customer's right to assign
This agreement and all rights under it may not be assigned or transferred by the Customer and persuant to Section 1(2)(a) of the Contracts (Rights of Third Parties) Act 1999 the parties intend that no term of this agreement may be enforced by a third party
Complaints
All complaints must be received in writing within 7 days of the function date
Proper law and jurisdiction
- This agreement shall be governed by English law in every particular including formation and interpretation and shall be deemed to have been made in England.
- Any proceedings arising out of or in connection with this agreement may be brought in any court of competent jurisdiction in England and Wales.
- The submission by the parties to such jurisdiction shall not limit the right of the Contractor to commence any proceedings arising out of this agreement in any other jurisdiction it may consider appropriate.
- Any notice of proceedings or other notices in connection with or which would give effect to any such proceedings may without prejudice to any other method of service be served on any party at the given address by first class post
- In the event that the Customer is resident outside England its address for service in England shall be the address for such service nominated at the head of this agreement and any time limits in any proceedings shall not be extended by virtue only of the foreign residence of the Customer.
